1. Acceptance of Terms
- Using Screen Story Co.’s services constitutes acceptance of these Terms.
2. Description of Service
- Services include website development, hosting, and maintenance.
- Customers receive access to their own website and may post “Content”.
- New features / tools are subject to these Terms.
- Requires internet access; users must pay any associated fees and provide their own equipment.
- Communications (service announcements, admin messages, newsletters) are considered part of membership.
3. Registration
- Must provide a valid email address and other registration data.
- User chooses password and account; responsible for maintaining confidentiality.
- Registration data must be true, accurate, current, and complete.
- If information is untrue/inaccurate, Screen Story Co. may suspend or terminate the account.
4. Fees & Payment
- Pay all applicable fees per service agreement.
- Screen Story Co. reserves the right to change prices at any time.
- Authorisation given to make necessary inquiries to validate account/financial info.
- Service charges are payable within 14 days of invoice (unless otherwise specified).
- Prices are inclusive of government taxes unless noted.
5. Cancellation & Termination
- Cancellation takes effect at the end of the current term.
- After cancellation: no access to website; all information may be deleted (no liability for loss).
- No refunds for unused prepaid portions unless terminated due to Screen Story Co.’s breach.
- Screen Story Co. may modify, suspend, or discontinue the Service (partially or entirely) at its sole discretion.
- May withhold, remove, or discard any Content without notice if deemed contrary to the Agreement.
- No obligation to store or provide copies of content.
6. Privacy Policy
- How Registration Data is collected, used, and protected is detailed in the Privacy Policy, which is part of these Terms.
7. Website Account & Security
- User is fully responsible for account security and all activities under it.
- Must immediately notify Screen Story Co. in writing of any unauthorized use or security breach.
- Screen Story Co. is not liable for any loss or damage from failure to comply with security obligations.
- No liability for acts/omissions of the user or any third party.
8. Content & Conduct Rules
- Screen Story Co. does not claim ownership of your Content; permission to host it lasts only while using the Service.
- You are solely responsible for all Content you post.
- Screen Story Co. does not pre-screen Content but has the right to refuse, move, or delete any Content that violates Terms or is objectionable.
- Content may be preserved/disclosed if required by law or to:
- Comply with legal process
- Enforce Terms
- Respond to third-party claims
- Protect rights, property, or personal safety
- Technical processing may involve transmissions over various networks and changes to conform to technical requirements.
9. Links
- Links to external sites/resources are provided for convenience.
- Screen Story Co. is not responsible for availability, content, advertising, products, or materials on external sites.
- No liability for any damage or loss caused by use of such sites/resources.
10. Indemnity
- You agree to indemnify Screen Story Co. (including officers, directors, agents, employees) against any claims or demands (including legal fees) arising from:
- Your Content
- Use of or connection to the Service
- Violation of these Terms
- Violation of any rights of another
11. Limitation of Liability
“WE WILL NOT BE LIABLE FOR ANY DIRECT, INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL OR EXEMPLARY DAMAGES … RESULTING FROM: (i) THE USE OR THE INABILITY TO USE THE SERVICE … (ii) THE COST OF PROCUREMENT OF SUBSTITUTE GOODS AND SERVICES … (iii) UNAUTHORIZED ACCESS TO OR ALTERATION OF YOUR TRANSMISSIONS OR DATA; (iv) STATEMENTS OR CONDUCT OF ANY THIRD PARTY ON THE SERVICE; OR (v) ANY OTHER MATTER RELATING TO THE SERVICE.”
- Aggregate liability cap: Amounts paid by you in the past three months for the Service in question.
